4.1. What is alternative dispute resolution?

Alternative dispute resolution is the option available to all consumers to turn to official entities that assist them in resolving or mediating a conflict before initiating legal proceedings in court.

Generally, the procedure is as follows: the customer asks an impartial third party to act as a mediator between themselves and the merchant who is the subject of their complaint. The mediator may suggest a solution to the complaint, impose a solution on both parties, or bring the parties together to find a solution.

You may be familiar with the concept of alternative dispute resolution under other names: “mediation,” “conciliation,” “arbitration,” or “consumer dispute resolution commission.”

Alternative dispute resolution is generally less expensive, less formal, and faster than going to court.
